Kenya has become the latest country to join the Beijing Treaty.
Performers Rights Society of Kenya (PRISK) has been on the forefront pushing for the ratification of Beijing treaty by the government of Kenya. PRISK wrote enough support memoranda and now a performer in audiovisual performances is better protected.
The Treaty deals with the intellectual property rights of performers in audiovisual performances.
The Communications Authority of Kenya (CA) and the Kenya Copyright Board (KECOBO) have given all broadcast service providers and telecommunications content service providers until 29th November, 2019 to adhere to their copyright obligations as provided for in the CA license conditions and ensure adherence to any other law as they carry out their services.
Kenya Association of Music Producers, Performers Rights Society of Kenya and Music Copyright Society of Kenya applaud the Kisumu judicial review ruling issued by Justice Fred A. Ochieng that clears the way for the three Collective Management Organizations to continue with the Joint Copyright and Related Rights licensing.
In the new ruling issued on 5th November, Justice Fred A. Ochieng directed the 3 collective management organizations i.e. KAMP, PRISK, and MCSK to continue with the joint collections for a period of 60 days.
NOTICE IS HEREBY given to the general public involved in BROADCASTING, COMMUNICATION TO THE PUBLIC, PERFORMANCE IN PUBLIC PLACES and MECHANICAL REPRODUCTION of copyrighted works THAT:-
1) KENYA ASSOCIATION OF MUSIC PRODUCERS (KAMP) – Administering and Managing Economic Rights of Producers of Sound Recording;
2) PERFORMERS RIGHTS SOCIETY OF KENYA (PRISK) – Administering and Managing Economic Rights of Performers in Sound recordings and audio-visual works; and
3) MUSIC COPYRIGHT SOCIETY OF KENYA (MCSK) – Administering and Managing Economic Rights of Authors, Composers, Arrangers and Publishers of musical works.
KAMP, PRISK and MCSK have been licensed as Collective Management Organizations (CMO) as per the provisions of Section 46 of The Copyright Act, 2001, Laws of Kenya to issue a JOINT COPYRIGHT LICENSE.
